Elder Abuse and Financial Exploitation: A Framework for Investigation

The Federal Law Enforcement Training Center (FLETC) in conjunction with the Office on Violence against Women (OVW), the National Sheriff’s Association and the National Clearinghouse on Abuse in Later Life has recognized the need for training law enforcement in recognizing and investigating elderly abuse. The fastest growing population in the country right now is that of the aging due to the Baby Boomer population. Inaccurate perceptions about aging has resulted in abuse cases not being recognized as such and the victims being put at a higher rate of risk.
This presentation provides guidance and techniques for investigating financial exploitation. Utilizing actual cases, it will address the following issues: initial response, recognizing and collecting essential evidence, interviewing, documentation, and identifying and overcoming common defenses. Specific focus will be given to critical issues such as capacity, consent, Powers of Attorney, and undue influence and the necessary evidence to support a criminal case. The importance of a multidisciplinary response will be emphasized to include the use of experts. Speakers include national, local and judicial experts.
1. Understand the special challenges in investigating financial exploitation.
2. Plan and carry out a follow-up investigation to include identifying essential evidence.
3. Develop interviewing skills and techniques that maximize the collection of information and evidence.
4. Describe the critical issues associated with capacity, consent and undue influence.
5. Develop an effective strategy to overcome common defenses.
This training is being hosted by the Unified Court System of NYS and the Erie County Elder Abuse Training Team.
Course Cost: There is no course cost for law enforcement. A working lunch is included.
